Terms and Conditions

By entering into this agreement, the Client acknowledges that TapinTravels (the “Contractor”) has the necessary qualifications, experience, and expertise to provide the services described herein. The Contractor agrees to deliver these services based on the terms outlined in this document. In consideration of the mutual benefits and obligations specified, both parties agree as follows:

1. Services Provided

The Client agrees that the Contractor will provide the following services for the entire duration of the trip:

  • The rental property

  • Management, curation, and booking of excursions and reservations

2. Additional Services

Both parties may agree to additional tasks or services beyond those specified, which will also fall under the scope of this agreement.

3. Agreement Commencement
This agreement will take effect once it is signed by the Client or once the Contractor receives the initial payment, whichever occurs first. The agreement cannot be terminated early. Any extensions to this agreement must be agreed upon in writing by both parties.

4. Payment Policy

All deposits are non-refundable and required to secure your reservation

  • .A 7-day grace period is provided after the deposit is made. If the Client cancels within this period, a full refund will be issued. 
  • If the trip is paid through an installment plan, the Client must make payments on time as agreed. If the Client fails to make two (2) consecutive payments without providing a valid reason, the Contractor reserves the right to terminate this agreement and cancel the booking without refund.
  • Cancellations made 90 days or more before the scheduled departure date will be eligible for a 50% refund of the total amount paid (excluding the non-refundable deposit).

  • No refunds will be issued for cancellations made less than 90 days prior to the departure date.

  • Failure to show up for the trip without prior written notice will result in a forfeiture of all payments made, with no exceptions.

5. Performance Commitment
Both parties agree to perform their duties and obligations in good faith to ensure the proper execution of this agreement.

6. Currency
Unless otherwise specified, all monetary amounts referred to in this agreement are in US Dollars.

7. Deposit Requirement
A deposit, is required to be paid to the Contractor before any work or services will begin.

8. Compensation Method
Payments from the Client will be processed through the WeTravel platform, in accordance with the terms specified.

Intellectual Property & Ownership

9. Ownership of Materials
All intellectual property created, developed, or provided under this agreement, including branding, marketing materials, content, itineraries, and media related to the trip, will remain the sole property of TapinTravels. The Client has no right to use, reproduce, or repurpose any such materials for commercial purposes outside of this agreement.

10. Client’s Property
The Contractor is not liable for any loss or damage to the Client’s personal property, including but not limited to passports, luggage, jewelry, and other belongings.

11. Return of Property
Upon termination or expiration of this agreement, the Contractor will return any Client property, including documentation, records, or confidential information.

General Provisions

12. Relationship of the Parties
This agreement does not establish a partnership, joint venture, or employment relationship between the Client and the Contractor. It is a contract for services.

13. Indemnification
Each party agrees to indemnify, defend, and hold harmless the other party, including its affiliates, officers, agents, and employees, from any claims, damages, liabilities, or expenses arising from any act or omission in connection with this agreement. This indemnity survives the termination of the agreement.

14. Assignment
The Contractor may not assign or transfer its obligations under this agreement without the prior written consent of the Client.

15. Governing Law
This agreement will be governed by the laws of the State of New York, without regard to its conflict of laws principles. All legal proceedings related to this agreement shall be conducted in New York.

16. Waiver
Any failure by the Contractor to enforce any provision of this agreement shall not be considered a waiver of future enforcement of that provision or any other provisions.

17. Military Service Members
Active military service members are bound by the terms of this agreement. However, if a service member provides proof of a military order that prevents them from attending the trip, the Contractor agrees to credit any payments made toward future trips. This clause is subject to reasonable and good-faith consideration.

18. Insurance Requirement
The Client is solely responsible for purchasing Trip/Travel Insurance to cover any potential losses during the trip. The insurance should cover, but is not limited to, personal injury, death, negligence, emotional distress, and other damages arising during the term of this agreement.

Acknowledgment

By booking and/or purchasing a payment plan via the WeTravel platform, the Client acknowledges that:

  • They have read and fully understand the terms and conditions of this agreement.

  • They understand this agreement cannot be canceled or terminated by them.

  • They have an unconditional obligation to make all payments due under this agreement, and they cannot withhold, reduce, or offset any payments for any reason.
